1. Acceptance of Terms

By using our Apps, you affirm that you are at least 13 years old (or the age of majority in your jurisdiction) and are capable of entering into a binding agreement. If you are using the Apps on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. User Accounts

To access certain features of our Apps, you may need to create an account. You agree to provide accurate and complete information during the registration process and to update that information to keep it accurate, complete, and current. You are responsible for safeguarding your account password and for any activities or actions under your account.

Moodify Brands, LLC grants you a limited, non-exclusive, non-transferable license to download, install, and use the Apps for personal, non-commercial purposes, subject to these Terms. You agree not to modify, distribute, or create derivative works based on the Apps without our prior written consent.

4. Prohibited Conduct

You agree not to use the Apps for any unlawful or prohibited purpose. This includes, but is not limited to:

• - Engaging in any conduct that restricts or inhibits anyone’s use or enjoyment of the Apps.

• - Transmitting any unsolicited or unauthorized advertising or promotional material.

• - Interfering with or disrupting the security, integrity, or performance of the Apps.

• - Attempting to gain unauthorized access to the Apps or their related systems or networks.

• - Moodify Brands is committed to maintaining a safe and respectful platform for all users and takes the safety of children extremely seriously.

• 1.) We have a zero-tolerance policy for any content involving child sexual abuse or exploitation (CSAE), including any form of sexualization of minors or the sharing, saving, or distribution of inappropriate material involving minors. Any violation of this policy may result in immediate removal of content, suspension or termination of user accounts, and reporting to appropriate law enforcement authorities where required.

• 2.) Moodify Brands is a fully offline application. We do not host, store, or transmit user-generated content to any external servers. However, we take child safety seriously. If you believe any part of our application or its distribution violates Child Safety Standards, please contact our Point of Contact immediately.

• 3.) If you encounter content that may violate this policy, please contact us immediately. Moodify Brands complies with Google Play’s Child Safety Standards Policy and all applicable laws and regulations regarding the protection of children.

5. Intellectual Property

All content, features, and functionality within the Apps, including text, graphics, logos, and software, are the exclusive property of Moodify Brands, LLC, or its licensors. You agree not to reproduce, distribute, modify, or create derivative works of any content from the Apps without express permission.

6. Disclaimers & Limitation of Liability

The Apps are provided on an "as-is" and "as-available" basis. Moodify Brands, LLC makes no representations or warranties of any kind regarding the operation of the Apps, or the information, content, materials, or products included in the Apps. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

In no event shall Moodify Brands, LLC be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Apps.

7. Changes to The Terms

We may revise these Terms of Use from time to time. Any changes will be effective immediately upon posting the updated terms in the Apps. Your continued use of the Apps after any modifications to the Terms constitutes your acceptance of the new terms.

8. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the state of Illinois, without regard to its conflict of law principles.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to our Privacy Policy.

10. Child Safety & Protection

We have zero tolerance for child sexual abuse and exploitation (CSAE).

If any user finds inappropriate content involving minors, they can report it immediately.

We comply with all applicable child safety laws and cooperate with legal authorities.
